Hours Over 8 Grievance settlement
Most of you received an email yesterday stating you was part of the Hours Over 8 settlement and that you would receive a payment for your portion of the settlement. I would like to clarify what this is in regards to. As most of you know, in July of 2012 the Local filed a Class Action grievance against the Company for denying overtime hours that should have been paid for any hours worked in excess of 8 hours in a day. In September of 2014 the Arbitrator ruled in favor of the Union and the settlement process began between this Local’s Executive Board and the Company. During the 4th settlement meeting on December 4th, 2015, the Company and the Union came to a settlement agreement. Please pay close attention to your pay stub this week and verify that you received a settlement payment. In the next few days, I will be sending out an explanation letter as to how the payments were determined for each individual. Also, the Company will be sending out a training document on how you should have been coding your time, in your respective time reporting system, in order to receive the proper pay for hours that you worked that were over 8 hours in a day. After the training you will be given the opportunity to get with your supervisor and/or the payroll department to go back to September 2014 to present day and make any corrections to your time that may have been coded and paid incorrectly, in other words, should have been paid at time and a half and was only paid at straight time. Please keep in touch with your Steward and continue to visit the website, www.cwalocal6372.org, for additional information in regards to this matter.
Sincerely,
Benny Hooper
